Dear Editor:
Proposition 64 is a misleading ballot initiative that claims to end frivolous lawsuits; it actually guts a highly effective law for protecting Californians from public health dangers, environmental damage, and consumer fraud. The Unfair Competition Law (UCL) has stopped oil companies from contaminating drinking water, prevented grocery store chains from changing expiration dates on unsafe meat, and forced bottled water companies to filter out arsenic and bacteria.
If passed, Prop 64 would eliminate the right of public interest groups to bring legitimate lawsuits to enforce environmental, consumer, privacy and public health laws under UCL—before people are hurt or seriously ill. These cases aren’t about money (no damages are possible), but injunctive relief to stop dangerous, illegal practices. Prop 64 was put on the ballot by corporate interests—not small businesses—who want to dismantle a powerful weapon for consumer and environmental groups to stop corporate crime.
Real solutions for stopping “shakedown” lawsuits are pending in the legislature, but none are contained in Prop 64.
Groups such as the American Lung Association, the California League of Conservation Voters, the Consumers Union, the Sierra Club, and the California Nurses Association have all gone on record to oppose Prop 64. I urge all Californians to vote NO on Prop 64.
